Christmas in a Small Town: HEADING

Your Town Terms of Service

Customer has written and submitted to Ricky Tims Inc. (“Ricky”) a personal holiday memory (the “Material”). Customer grants Ricky an irrevocable non-exclusive, perpetual, worldwide right and license (i) to incorporate the Material into the website known as “Christmas In A Small Town” (www.christmasinasmalltown.com; the “Website”) and any versions, sequels or derivative uses thereof; (ii) to publish and distribute the Material on the Website and in any printed or electronic form, media, language or technology, now known or later developed; (iii) to reproduce, modify, translate, distribute, perform and display the Material on the website and in other forms as described above and in advertising, publicity and promotion in connection with Christmas in A Small Town and/or the other uses of the Material. Ricky may edit, reproduce, modify, adapt or otherwise use the text of the Material alone or in combination with other materials including text, images, animation, graphics and video alone or in combination with other materials including text, images, animation graphics and video. Ricky shall have no obligation to use the Material.

Customer represents and warranties that (i) Customer has the full right and authorization to license the Material to Ricky and Ricky may use the material without permission from any other person and (ii) the Material does not and shall not infringe any intellectual property rights of any person or violate any laws. Customer acknowledges and agrees that Customer shall have no copyright or other rights to the use of the Material in connection with the grant of rights herein or any benefits derived therefrom.

Customer represents that he or she is over 18 and has read and understands the meaning of this release.
